What is the Ford diesel emissions scandal?

In 2015, Ford was found to have been producing diesel vehicles that emit higher levels of nitrogen oxide (NOx) that surpass the levels allowed by European regulations. The car manufacturer’s diesel vehicles were found to be emitting up to seven times beyond the legal limit.

Excess levels of NOx can lead to increased air pollution, damage to the ozone layer, and can cause a variety of negative impacts to public health. Additionally, high levels of NOx can be harmful to vegetation and lead to damaged foliage, as well as a reduction in crop yields and reduced growth. Ford’s customers were misled when buying their diesel vehicles, with customers having to spend more money on ‘fixing’ their vehicles.

Ford, like other major car manufacturers, had equipped their diesel cars and vehicles with defeat devices, which manipulate emissions tests. These devices were used to cheat emissions tests by displaying lower emission readings during testing compared to the results found during real-world driving conditions.

While research conducted in Belgium found that Ford hadn’t fitted its cars with the same defeat device as other car manufacturers, they had installed a different type of defeat device. Some Ford diesel vehicles were found to have a ‘thermal window’ installed.

What is the thermal window defeat device?

The thermal window software works to switch off the exhaust gas purification system when the outside temperature is out of the 15-33 C° range, or if the vehicle is driven on terrain above 1000 metres altitude. Ford had previously argued that the software is legal for them to install, as it acts to protect the engine against “damage or accident” and to ensure the “safe operation of the vehicle”.

The European Court of Justice seemed to dismiss this reasoning, insisting that in order to use this justification “the presence of such a device must allow the engine to be protected against sudden and exceptional damage.” Meaning that the legal exemption is unlikely to cover long-term degradation instances. In 2022, the European Court of Justice confirmed that thermal windows are illegal defeat devices.

Am I eligible to make a Ford diesel emissions claim?

An exact list of all the affected diesel car models is not known and may vary. However, if you purchased or leased a Ford vehicle with a diesel engine (in England or Wales) that was manufactured between January 2008 and December 2018, you may be entitled to compensation.

Typically, the vehicle manufacturer (in this case Ford) would opt to settle the case out of court. Additionally, the precedent that was set during the Volkswagen case can also result in a reduced litigation time.
