What Is The Kia Diesel Emissions Claim Scandal?

ne of the most well-known diesel scandals came about when news surrounding Volkswagen surfaced in 2015. However, this wasn’t the first diesel emissions scandal of the time. One year prior, in 2014, South Korean car manufacturer Kia was fined by the United States Environmental Protection Agency. Kia was forced to pay $100 million, after they were found to be in violation of the Clean Air Act.

In addition, Kia was also found to have supplied their customers with inaccurate information regarding the fuel economy performance of specific vehicles in real-world scenarios.

Following the news, Kia was placed under more scrutiny. In a study completed by the Transport and Environment Agency, Kia was found to be one of the worst car manufacturers for emissions. Looking into their findings more deeply, specific Kia car models were found to be emitting over six times the amount of nitrogen oxide (NOx) that is permitted in Europe.

It is believed that Kia was able to do this by installing thermal windows in their vehicles. These devices are thought to be similar to the defeat devices Volkswagen was using before their diesel scandal made headline news.

In 2022, Kia, with the addition of Hyundai on this occasion, were in trouble again. This time multiple locations in Germany and Luxembourg were searched by the German authorities after it was alleged that the two companies had over 210,000 vehicles with defeat devices installed.

What Kia Vehicle Models Have Been Affected?

While many years have passed since the Kia diesel scandal news broke, the investigations related to the scandal are still ongoing. This means there is still no complete list regarding how many vehicles, or the car models, that have been affected.

Specific car models that have been tested include the Kia Sportage III 1.7 and 2.0 litre models. Both were found to have defeat devices installed, and were negatively impacted. However, following the more recent discovery in Germany and Luxembourg (mentioned above), it is believed that if you purchased or leased a diesel Kia vehicle that was manufactured between 2008 and 2020, then there is a high likelihood that it may have had a defeat device installed.

How Much Compensation Can I Receive From My Kia Diesel Claim?

As we have previously mentioned, the investigations into the Kia diesel scandal are still ongoing. This means that while the news broke a few years ago now, the scandal is still relatively new.

Currently, there is no standard guidance regarding how much compensation you may receive from your Kia diesel claim. Each case is considered on an individual basis, meaning that the amount of compensation you may receive will vary. Kia Diesel Claims FAQs

What our customers ask us

How Long Will My Kia Diesel Claim Take?

Sadly, this is another question we are unable to give a straightforward answer to. As this is a relatively new scandal, there is no precedence that we can follow. Cases can take either weeks, months, or even years to be decided.

One of the main factors that can influence a case’s timeframe will be how much Kia is willing to admit to any wrongdoing. If they are not, and the case goes to court, you may be waiting quite some time to receive your compensation. However, if they decide to settle outside of court, the timeframe will reduce massively.

A thermal windows device can be used to manipulate emissions tests when a vehicle is being manufactured. While the installation of one of these devices is perfectly legal, as they can prevent both rust and decay as well as minimise the build-up of condensation within a vehicle’s engine, it is a grey area.

This type of defeat device can be used to switch off the exhaust gas purification system after vehicle testing. When this happens, the vehicle will emit gases that are unfiltered, which is detrimental to both the environment and public health.

If you have either owned or leased a Kia diesel vehicle that was manufactured between 2008 and 2020, you may be eligible for compensation. In order to move forward with your case, you will need to provide us with documentation that proves your ownership of that specific vehicle. If you are no longer in possession of the vehicle, you will also need to provide proof of sale.

Yes, you are able to make as many claims as you would like. If you have owned or leased multiple Kia vehicles that fulfil the eligibility criteria, you can claim on all vehicles. However, don’t forget that you will need to provide the necessary documentation that proves your ownership of each given vehicle in separate claims.
