What is the Mercedes diesel emissions scandal?

For any vehicles to be legally allowed on the road in the UK, they must pass the appropriate emissions tests. However, Mercedes-Benz’s parent company Daimler AG was found to have used defeat devices in their diesel cars and vans produced between 2009 and 2018. These devices were designed to trick emissions tests so that the vehicles would be shown to produce fewer emissions than they actually were in real-life driving conditions.

The German Federal Motor Transport Authority (KBA) found that Mercedes installed the devices to limit emissions readings during testing. As a result, the tests were misrepresented, and the emissions produced did not comply with EU requirements.

Daimler was fined £776 million by German prosecutors over the emissions scandal and the KBA ordered Mercedes to recall roughly 90,000 vehicles across England and Wales. Mercedes also voluntarily decided to recall hundreds of thousands more vehicles. Litigation has already been started against Mercedes in other jurisdictions, including Germany, Canada, and the United States.

What impact did the diesel cheat device have on Mercedes owners?

Drivers who bought affected Mercedes vehicles were lied to about their eco-friendliness and overall efficiency and likely suffered losses as a result of that deception. This is because the vehicle would most likely have been worth less in terms of resale value than it should have. If owners were offered the ‘fix’ to be applied by Mercedes, it has been reported that the vehicle’s performance and fuel economy deteriorated afterwards.

The increased levels of nitrogen dioxide emissions are harmful not only to the environment but also could impact people’s health. NOx in general is thought to contribute to an estimated 40,000 premature deaths in the UK each year.

Those who owned or leased an affected diesel vehicle could be entitled to thousands of pounds of compensation through a Mercedes claim. You can join many other Mercedes owners around the country who have already registered for the group action vehicle emission claim

Why should you make a Mercedes-Benz emissions claim?

There are multiple reasons why you should consider making a Mercedes diesel emissions claim.

Corporate accountability

We believe that Mercedes deliberately misled its customers as to the real number of emissions being produced by their diesel vehicles. This in itself is a shocking betrayal of trust and many drivers have the right to be angry and want to hold Mercedes accountable for its actions. Mercedes and its parent company Daimler need to face their customers and the consequences of what they have done.

Environmental impact

When a car engine burns diesel, nitrogen oxides, which are a group of reactive gases, are released into the atmosphere. The two gases which have the most serious and detrimental impact on the environment are nitric oxide (No) and nitrogen dioxide (No2). Diesel engines are renowned for producing high levels of nitrogen oxides, hence why it was so significant that Mercedes promoted its diesel vehicles as being ‘the cleanest ever’. However, we now know that under regular driving conditions, these vehicles were producing up to 40x the EU and UK emissions limits.

The gases produced are very dangerous and can cause acid rain and smog which damage wildlife and destroy fragile ecosystems as well as being the main contributor to global warming and climate change. Mercedes had no regard for protecting the planet when they tampered with their emissions or for how drivers would vehicle if they knew they were driving a car that was such a big pollutant.

Looking after your health

As well as being a danger to the environment diesel emissions are bad for human health as they are known to cause respiratory issues and exacerbate existing conditions. Again, Mercedes only thought of their profits and not the health and safety of the customers buying their vehicles. Drivers have the right to claim compensation for any suffering they have experienced as a result of Mercedes’ selfish and reckless actions.

Compensation for any financial damages

Mercedes customers might have suffered substantial losses as a result of the emissions scandal. This is because there could have been a decrease in the car’s market value, so they paid more for it than it was actually worth. Also, they would have had higher fuel bills and maintenance costs, especially if they have the ‘fix’ applied which potentially had a negative effect on the vehicle’s performance as well as fuel economy.

Nothing to lose

The law firm we will put you in touch with works on a No Win, No Fee basis, so it won’t cost you anything to claim, even in the unlikely event that the claim was unsuccessful.

Which vehicles are said to be affected by the scandal?

A number of Mercedes models with diesel engines that were sold between 2008 and 2018 are likely to be affected by the emissions scandal. This includes the following models of Mercedes diesel vehicles:
A-class B-class C-class Citan
CLA CLS E-class GL-class
GLA-class GLC-class GLE-class GLS
GLK M-class S-class SLK
Sprinter V-class Vito
However, there are additional models that are likely to be involved in the diesel emissions scandal, so it is still worth making an enquiry even if your vehicle does not appear in the list above. These claims also include diesel passenger and commercial vehicles and vans.

Mercedes Emissions Claims FAQs

What our customers ask us

Can you still make a Mercedes emissions claim if you sell your vehicle?

Yes, you can sell your car now or at any time in the future and still be able to make a claim. Selling or replacing your car won’t affect any claim that you might have if your vehicle is one of the affected diesel vehicles. However, you must have your vehicle registration number/VIN and be able to provide your vehicle purchase documents or a copy of the logbook showing you as the registered keeper.

No, it is not necessary to have bought your car through MBFSUK to be able to make a claim. It is only helpful to have details about the finance provider of the vehicle because those who bought their car through MBFSUK might have additional claims against MBFSUK.

Yes, you can make a Mercedes-Benz emissions claim provided that you leased an affected vehicle, you are the registered keeper, and the finance agreement is in your name. You are eligible to make a Mercedes claim if you financed your vehicle with:

  •       Hire Purchase
  •       Personal Contract Purchase (PCP)
  •       Personal Contract Hire (PCH)
  •       Lease

Yes, you are still eligible to be a claimant even if you have planned to sell your vehicle once proceedings have been issued. It would help your claim if you can get the VIN and copies of any documents you hold, such as the finance agreement or invoice, as well as the identity of the buyer of your car and the price you sold it for.

At this early stage, you could register your interest with more than one law firm, although we believe your interests will be best protected by joining the law firm we put you in contact with. However, you will be required to choose which Group Litigation Action to join at a later date when the participation documents are given to you, the respective claims have been explained to you in detail, and before formal claims are filed.

That depends on your personal case. You should provide as much information as possible about your losses, including any complaints that you might have made at the time, and upload any supporting documents that you have as evidence. This will help your lawyer assess the value of your claim and ensure you get the amount of compensation you deserve.

As soon possible, there is a time limit for you to start your claim. If you wait too long to register, you might not get all the compensation you are owed, or your claim could be thrown out completely. You should check if you’re eligible and get started with your claim now to get the maximum amount of compensation you are entitled to.

You might have already received a recall letter from Mercedes confirming that your vehicle is affected. If not, you can check if you’re eligible to claim quickly and easily with an online vehicle registration checker.

These types of cases are quite complex litigations with the defendants putting forward a lot of challenges as they realise the damage potential is so great. Looking back at similar cases in the past, they can take time to progress in court with there being many procedural and legal arguments being made.

You will be regularly informed of any progress when you sign up for your Mercedes diesel claim, however, you should expect a minimum of 2-3 years, but there is uncertainty due to the pandemic. Our recommended law firm has extensive experience in these cases and will make every effort to resolve the case timely whilst still securing you the best result and compensation you deserve.

It is difficult to predict exactly how much compensation you might receive through your Mercedes-Benz emissions claim as each client is different and there will be a range of influencing factors. For example, the vehicle model and age, how much you paid to buy or lease the vehicle etc. However, we think it is likely that each claimant could receive thousands of pounds per vehicle.

If you bought or leased your car in Scotland or Northern Ireland, you won’t be able to join a claim in England and Wales. You can only start a claim in the country where you acquired the vehicle, regardless of where you live. Even though a lot of the same problems apply, the claims being made in Scotland and Northern Ireland are separate and at earlier stages than in England and Wales. In Scotland for example, the legal mechanism that makes group actions possible was only introduced last year, meaning cases have not progressed very far yet.

We can put you in touch with legal experts who are putting together a group action whereby thousands of customers can be part of a collective Mercedes-Benz emissions claim for compensation. Our recommended experts will act for you on a No Win, No Fee basis, meaning there is no risk to you in making a claim, and no upfront costs involved. Any legal costs would be taken as a percentage of your compensation award. Contact us today to find out more and start your Mercedes emissions claim.
