The past decade has seen a rise in scandals surrounding car manufacturers producing vehicles that emit far too much harmful pollutants to be healthy for human exposure. This series of scandals is often dubbed “Dieselgate”. The main pollutant that is being released is Nitrogen Oxide, aka NOx. NOx has the following harmful effects on the human body: 

  • Irritation – NOx can irritate your eyes, causing itchiness and redness. 
  • Respiratory Infections – NOx can negatively affect a person’s breathing by irritating the airways and lungs. Symptoms include coughing, wheezing, and shortness of breath. In the long term, a person can develop serious conditions such as chronic bronchitis and pneumonia. 
  • Cardiovascular Issues – NOx can intensify the growth of ground-level ozone, a type of air pollution that causes a range of issues, from increased stress and high blood pressure to strokes and heart failure. 
  • Weakened Immune System – NOx can weaken the immune system by damaging the respiratory lining over time. This puts you at a more severe risk of contracting illnesses, both general and serious.

How do I know if I’m eligible for a Peugeot Diesel Emission Claim?

In order to make a claim, you must have been in possession of a Peugeot diesel vehicle affected by the defeat device. 

You must have either owned or leased, the vehicle in question in the following ways:

  • You bought the vehicle that affected you, either new or second-hand. 
  • The car was leased to you, meaning you used it for a set period of time as per a contract made. If you leased from a person through a verbal agreement, compensation may be harder depending on whether or not said person is willing to corroborate your information.
  • If you had a company car given to you that is of the affected model and make. 
  • If you had once owned an affected car, but have since sold it. 
  • If you purchased the car through a salary contributive scheme via your employer. 
  • If you owe money on the vehicle’s finance.

 

 

Furthermore, you will need proof of the following. 

  • Documentation – Proof of ownership of a vehicle affected by the emission cheating software is vital. You should also have any contracts, warranty information or maintenance information on hand.

What is the average compensation for Peugeot Diesel Emission Claims?

The truth is, it’s impossible to find figures on the average compensation you may get as a result of a successful Peugeot claim. Many elements come into play in a pay claim case. This can be used to highlight costs made to a vehicle bought under fraudulent circumstances, meaning you may be able to claim the money back. Servicing done specifically to the emission of the vehicle is particularly effective in this claim, especially if there’s any recognition of the emission issue from repair services or even Peugeot itself.
  • Recall Notices and Correspondence – Recall notices are made by a manufacturer or its authorised dealerships in response to a hardware or software issue within the vehicle. These are made in response to a fault with the vehicle that could pose a risk to the users’ safety. These notices are usually delivered via mail and will contain information on the specific risk. On top of that, you will have received documentation after the repair/update that will outline the actual changes made.
  • Expenditure due to emission fault – It may be possible to claim back costs or losses that you can attribute to the emission scandal. This could be something as simple as having to pay for increased fuel costs, or perhaps you sold your vehicle already but suffered a loss due to the plummeted resale value.
  • Witness statements – If you can, gathering written witness testimony to those who experienced the emissions fault of your vehicle helps in proving legitimacy. For example, if your car was serviced and the mechanics noticed the problem, getting a written statement from them to present to the court will help your compensation claim a lot.

The short answer to this is yes. If you still have your proof of ownership, then you still can make the claim that you were affected by the emission scandal and be entitled to compensation. 

On top of that, you may be able to claim compensation for the reduced resale value of your vehicle if you sold it after the news was dropped. It’s pretty common knowledge that due to the scandal, the amount of recalls and the money lost, there has been a great deal of damage done to the reputation of the car manufacturer Peugeot. 

As a result, many of the affected Peugeot vehicles have suffered a reduction in resale value. If you sold your Peugeot car during this time, then you may be able to recoup some of the cost. 

The Peugeot diesel vehicles that were affected by the Dieselgate scandal, meaning they were found to be equipped with emission defeat software, included the models below. That being said, understand that whilst the defeat device was found within the following models, that doesn’t necessarily mean that all vehicles will have the device in them – after all, some cars were recalled and/or modified. Also, whilst the investigation has mostly finished, it is still open – meaning that there may be further news that changes circumstances.

The models affected so far are the following:

  • Peugeot 208 (1.6-litre engine)
  • Peugeot 2008 (1.6-litre engine)
  • Peugeot 308 (1.6-litre engine)
  • Peugeot 3008 (1.6-litre engine)
  • Peugeot 508 (1.6-litre engine)
  • Peugeot 5008 (1.6-litre engine)
  • Peugeot Partner (1.6-litre engine)
  • Peugeot Expert (1.6-litre engine)
  • Peugeot Boxer (2.0-litre engine)

In the same year 2015, an investigation was initiated into the parent company of Peugeot, PSA Group, with the intention to investigate emission test cheating after it was reported that their diesel vehicles were emitting higher levels of nitrogen oxide than usual. They tested a range of Peugeot cars in normal driving conditions and found that a range of their diesel lineup, with the 208 and 508 models being prime examples, had emission-cheating software that falsified feedback. This resulted in the recalling of over 100k vehicles and a sixty million euro fine. 

If you owned any of the affected and recalled models, then you could be entitled to financial compensation for the following reasons: 

  • Fraud – The use of diesel emission cheat software essentially means that you did not purchase a vehicle that was up to standards. This false advertisement is fraud. This fraud is magnified when you take into account the following reasons. 
  • Impacts on Health – By purchasing a car with emission-cheating software, you have unknowingly put yourself and any who has been near your vehicle during its running to the health issues that have been outlined above. Even if you have no outright condition, the inhalation of these pollutants is still unacceptable and poses unknown risks to your future.  
  • Warranty Breaching – If you have purchased a warranty with Peugeot, there will be a section detailing their coverage of defects and malfunctions that occur during genuine use of the vehicle through genuine everyday use. However, considering the existence of hidden emission-cheat software, there’s a case to be made that the manufacturer was never in a position to meet their end of the warranty agreement when it was signed. 
  • Lowered Value – As a result of the scandal, both the public image of Peugeot and the monetary value of the cars have plummeted due to diminished trust between the company and the consumer.
