What is the Vauxhall emissions scandal?

It has been alleged that Vauxhall tried to cheat emissions tests by installing illegal defeat devices into hundreds of thousands of their diesel vehicles in the UK. As such, those eligible can make a diesel emission claim. And making Vauxhall diesel emissions claims couldn’t be simpler when you check if you have a claim with us. But first, let’s take a look at what caused the Vauxhall emissions scandal in the first place…

The issue was first discovered in 2018 by the German Federal Motor Transport Authority (KBA) and resulted in a mandatory recall of diesel Vauxhall vehicles in Germany. Vauxhall have denied claims of any wrongdoing, but they have also recalled 500,000 vehicles in the UK, and there could be many more overly polluting vehicles on the roads that have not been recalled.

The Department for Transport in the UK found that Vauxhall models were some of the worst tested out of all the manufacturers involved in the ‘Dieselgate’ scandal. Tests found that the Corsa exceeded NOx test limits by a factor of six, and the Insignia by a factor of ten, when driven on the road.

Because of this discrepancy, you might be eligible for a Vauxhall diesel emission claim if you are, or were, one of the many car owners who owned one of the affected vehicles.

What impact did the diesel cheat device have on Vauxhall diesel vehicles?

The defeat device was designed to trick the European Regulator’s tests into thinking the car was producing less emissions than it actually was when driving in the real world. This effectively allowed the car to bypass emissions regulations and, as a result, the cars did not meet the environmental and performance standards that customers were promised, and were effectively worth less than they originally purchased them for.

Vauxhall owners might have had to pay higher fuel costs and maintenance bills, especially if they had the ‘fix’ applied through the manufacturer, as it was reported that this reduced the performance and affected fuel consumption of the cars. Vauxhall has already contacted many drivers to offer an emissions software update to ‘fix’ the problem. If you were previously contacted by Vauxhall regarding this, your vehicle will most likely be eligible to be part of a claim.

The increased level of nitrogen oxide being produced could have impacted on the health of drivers and their passengers, as well as having an overly negative impact on the environment. NOx emissions add to outdoor air pollution which has been linked to more than 40,000 premature deaths in the UK each year (according to the Royal College of Physicians and Royal College of Paediatrics and Child Health report Every Breath We Take).

What vehicle models were affected in the scandal?

Any affected diesel Vauxhall model can be eligible to join the claim. Defeat devices were allegedly fitted in certain diesel vehicles like diesel-engine vans and cars including the:

Other Vauxhall models may also be affected by the diesel emissions scandal. If you drove a diesel Vauxhall model between 2008 and 2019, then you may be affected and it’s certainly worth checking if you might have a claim for free with us today.

What is the current position of the Vauxhall emission claims?

Vauxhall is one of the latest car manufacturers to be discovered in the dieselgate scandal. Therefore, the claim against them is currently in the early stages, but it could well follow the same path of other emissions claims, such as VW and Mercedes, that have paid out on claims without any admission of any wrongdoing.

Why should you make a Vauxhall emissions tests claim?

It is completely unacceptable that Vauxhall have misled their customers and put profits above public health and the safety of the environment. The five key reasons why you should make a claim are:

Protecting the environment – at a time when climate change and global warming are huge concerns across the world it is extremely selfish and reckless of Vauxhall to risk damage to our planet with their emissions. When released into the atmosphere, nitrogen oxide quickly gets converted into nitrogen dioxide which absorbs sunlight to create smog. It is smog that can exacerbate health conditions like asthma, bronchitis, and emphysema. Also, the pollutants can form acid rain and be washed into the ground, which can harm wildlife and destroy fragile ecosystems.

Corporate accountability – big companies like Vauxhall should not have their actions ignored and they need to be aware that they are not above the law.

Financial reimbursement for misrepresentation – you are entitled to compensation from Vauxhall as you were misled into believing your vehicle was within legal limits of emissions standards and your vehicle is likely not worth what you paid for it as a result of this deception.

Looking after your health – NOx is a very dangerous pollutant that is known to cause respiratory issues which Vauxhall disregarded and put drivers across the country at risk.

No risk to you – the law firm we will put you in touch with works on a No Win, No Fee basis so you have nothing to lose by starting a diesel emissions claim for Vauxhall today.

How much compensation could you receive for your Vauxhall emissions claim?

There is not currently any official guidance on the amount of compensation Vauxhall drivers could receive in their claim besides an estimate based on previous cases of between 25 and 75% of the purchase price of the vehicle. However, any potential compensation will depend on your personal circumstances (for example when you bought your vehicle, whether you bought it from an authorised dealer, and whether you bought it using finance). Therefore, it would be impossible to say that all claims would be worth a set amount, although it is likely that compensation could be in the thousands.

For customers who qualify to bring a claim under the Consumer Protection from Unfair Trading Regulations 2008 (CPUT) (those being drivers who purchased their vehicle on or after 1st October 2014, through an approved dealer or using approved finance and for non-business use) are entitled to recover a discount on payments that have been made, ranging from 25% to 100%. The compensation that is recoverable under other types of claims is more dependent on proving loss, and you might get a lower amount back than if your claim is under CPUT.

How long will it take to receive your Vauxhall compensation?

It is difficult to predict how quickly you might receive your compensation for your Vauxhall emissions claim because it will depend on their approach to the claim. Vauxhall might decide to make an early settlement offer, in which case the litigation could, depending on the terms of the offer, be over quite quickly. Your experienced lawyer will do everything in their power to ensure you get your compensation as soon as possible.

Vauxhall Emissions Claims FAQs

What our customers ask us

How can we help you with your Vauxhall diesel claim?

Over one million Vauxhall diesel owners in the UK could be affected by this scandal. If you owned or leased a Vauxhall diesel vehicle between 2008 and 2019, you could qualify to make a Vauxhall emissions claim. We can put you in touch with expert lawyers that are putting together a group action claim to help you get the compensation that you deserve.

You might be due money back because:

–> You would not have bought the vehicle if you knew about the alleged emissions problems.

–> You paid more for the vehicle than you normally would have.

–> Your car or van may have needed to be ‘fixed’ in order to be compliant with emissions standards, with the repair possibly resulting in worse fuel efficiency and/or performance.

–> The overall value of your vehicle could have been affected.

No, it is not important where you bought or leased your vehicle from as long as it was in England or Wales. You are eligible to bring a Vauxhall diesel emissions claim whether you got your vehicle from a showroom, a private seller, a third-party dealer, or if you bought the car for business purposes.

You cannot join this group action Vauxhall emissions claim, as to be eligible you would have had to have acquired your car in England or Wales. Also, the interests of drivers who bought or leased their cars in Scotland are better served by bringing their claims through the Scottish courts. It is likely that you will be better off going through a Scottish law firm that has expertise in this field. If you need help finding a suitable lawyer in Scotland you can contact the Law Society of Scotland.

Vauxhall has a nationwide network of car dealers. There are different ways of knowing if you bought your vehicle from an authorised dealer, Vauxhall provides details of the dealership on their website, and a franchise dealership’s name is likely to include the Vauxhall name and brand.

There are a few time limits that apply to the claims being brought:

  • Deceit/misrepresentation and breach of statutory duty claims need to be brought within 6 years of you learning (or if you could have learned with reasonable diligence) that your vehicle had a defeat device to cheat emissions. Given that Vauxhall’s emissions scandal didn’t come to light until January 2021, there’s still plenty of time to make a claim.
  • Breach of contract claims must be brought within 6 years of when the contract is breached, which in this case would be 6 years from the date of purchase.
  • CPUT claims have to be brought within 6 years from the date of when you make the agreement to buy the vehicle.
  • Consumer Credit Act claims should be brought within 6 years of the first payment made under your Vauxhall finance agreement. Although, it could be possible to bring the claim after that date but only in respect of receiving compensation for any payments made within 6 years or to be made in the future.

You can’t start a claim when the time limit for that particular type of claim has passed. If you have other types of claims that are well within time, as long as you have a potentially affected vehicle, you can bring a Vauxhall emissions claim. It is important to note, that if the relevant time limit has expired in one or more of your claims, it is quite likely to reduce the overall level of damages you would receive for a successful claim.

As the claim is currently in the early stages, it is near impossible to give an accurate prediction of the timescale. Like with any legal claim there are some things within control and some that are not. It will largely come down to Vauxhall’s response to the legal claim, as they are the defendant. In similar group claims that have happened in the past they could take two to five years to progress through the Court, but they may take longer. You will be given regular updates, especially relating to the timescale for next steps which can be more accurately provided than for the overall case as a whole.

Yes, as long as you have owned an affected vehicle you are eligible to make a claim against Vauxhall.

Yes, if the contract is in your name through a limited company or partnership and the vehicle is one of the ones affected with emissions flaws you can make a claim.

As long as you can confirm that you owned an affected vehicle, yes you can make a claim. You will need to check your vehicle registration number and you will be asked to provide vehicle purchase documents.

Provided that all the vehicles you want to claim for are affected, yes you are eligible to make a Vauxhall emissions claim. You will need to complete separate documents for each of your vehicles.

Yes, you are still allowed to claim no matter if your vehicle was bought brand new or second hand.

The claims are based around the argument that, if the buyer had known about the emissions flaws/defective parts, then this would have been an important factor in their decision to buy the vehicle or carry on making payments under a finance agreement. If knowing about the emissions problems makes little to no difference to your decision to buy the car, then you may not be able to claim.

We can put you in touch with legal experts who are putting together a group action whereby thousands of customers can be part of a collective Vauxhall emissions claim for compensation. Our recommended experts will act for you on a No Win, No Fee basis, meaning there is no risk to you in making a claim and nothing to pay in the unlikely event we take on your claim and you don’t win compensation.
