What is the Vauxhall emissions scandal?

It has been alleged that Vauxhall tried to cheat emissions tests by installing illegal defeat devices into hundreds of thousands of their diesel vehicles in the UK. The issue was first discovered in 2018 by the German Federal Motor Transport Authority (KBA) and resulted in a mandatory recall of diesel Vauxhall vehicles in Germany. Vauxhall have denied claims of any wrongdoing, but they have also recalled 500,000 vehicles in the UK, and there could be many more overly polluting vehicles on the roads that have not been recalled.

The Department for Transport in the UK found that Vauxhall models were some of the worst tested out of all the manufacturers involved in the ‘Dieselgate’ scandal. Tests found that the Corsa exceeded NOx test limits by a factor of six, and the Insignia by a factor of ten, when driven on the road.

What impact did the diesel cheat device have on Vauxhall diesel vehicles?

The defeat device was designed to trick the European Regulator’s tests into thinking the car was producing less emissions than it actually was when driving in the real world. This effectively allowed the car to bypass emissions regulations and, as a result, the cars did not meet the environmental and performance standards that customers were promised, and were effectively worth less than they originally purchased them for.

Vauxhall owners might have had to pay higher fuel costs and maintenance bills, especially if they had the ‘fix’ applied through the manufacturer, as it was reported that this reduced the performance and affected fuel consumption of the cars. How much compensation could you receive for your Vauxhall emissions claim?

There is not currently any official guidance on the amount of compensation Vauxhall drivers could receive in their claim besides an estimate based on previous cases of between 25 and 75% of the purchase price of the vehicle. However, any potential compensation will depend on your personal circumstances (for example when you bought your vehicle, whether you bought it from an authorised dealer, and whether you bought it using finance). Therefore, it would be impossible to say that all claims would be worth a set amount, although it is likely that compensation could be in the thousands. 

For customers who qualify to bring a claim under the Consumer Protection from Unfair Trading Regulations 2008 (CPUT) (those being drivers who purchased their vehicle on or after 1st October 2014, through an approved dealer or using approved finance and for non-business use) are entitled to recover a discount on payments that have been made, ranging from 25% to 100%. The compensation that is recoverable under other types of claims is more dependent on proving loss, and you might get a lower amount back than if your claim is under CPUT.

Vauxhall has a nationwide network of car dealers. There are different ways of knowing if you bought your vehicle from an authorised dealer, Vauxhall provides details of the dealership on their website, and a franchise dealership’s name is likely to include the Vauxhall name and brand.

There are a few time limits that apply to the claims being brought:

  • Deceit/misrepresentation and breach of statutory duty claims need to be brought within 6 years of you learning (or if you could have learned with reasonable diligence) that your vehicle had a defeat device to cheat emissions. Given that Vauxhall’s emissions scandal didn’t come to light until January 2021, there’s still plenty of time to make a claim.
  • Breach of contract claims must be brought within 6 years of when the contract is breached, which in this case would be 6 years from the date of purchase.
  • CPUT claims have to be brought within 6 years from the date of when you make the agreement to buy the vehicle.
  • Consumer Credit Act claims should be brought within 6 years of the first payment made under your Vauxhall finance agreement. Although, it could be possible to bring the claim after that date but only in respect of receiving compensation for any payments made within 6 years or to be made in the future.

You can’t start a claim when the time limit for that particular type of claim has passed. If you have other types of claims that are well within time, as long as you have a potentially affected vehicle, you can bring a Vauxhall emissions claim. It is important to note, that if the relevant time limit has expired in one or more of your claims, it is quite likely to reduce the overall level of damages you would receive for a successful claim.

As the claim is currently in the early stages, it is near impossible to give an accurate prediction of the timescale.
